Judicial activism - Essay Example In Roper v. Simmons, a seventeen year old by the name of Simmons confessed that he plotted the murder and burglary of an older woman. This case placed the question before the Courts as to whether or not a person younger than eighteen years old should be punished with the death penalty when convicted of crimes that would typically mandated capital punishment. The seventeen year old was originally sentenced to death for his crimes. This decision was later overturned by the Missouri Supreme Court and the defendant's sentence was converted to life imprisonment. The Missouri Supreme Court stated that although there were cases that illustrated that there was a precedent set that allowed for capital punishment for those persons under the age of eighteen, that a 'national consensus has developed against the execution of juvenile offenders'(2005). This case has since been heard by the United States Supreme Courts. Judicial activism and restraint are concepts that can be readily viewed in the Roper v. Simmons case when it was decided by the Supreme Court in March 2005. The majority opinion addressed both the Eighth and Fourteenth Amendments when considering the affirmation of the Missouri Supreme Court decision. ... Per the court's opinion, neither the Eighth nor the Fourteenth Amendment disallows the use of the death penalty for either persons that are under the age of eighteen or that are deemed mentally retarded. The Court's majority states that twenty-two of thirty-seven death penalty states permit the death penalty for the offenders that are sixteen years old. The same thirty-seven states permitted the death penalty for those offenders that were seventeen years old. The Court went further to state that such figures are not indicative of a nation that is moving towards a consensus against capital punishment for those offenders that are less than eighteen years of age. Two court cases were consistently referenced in the opinion: Stanford v. Kentucky 492 U.S. 361 (1989) and Atkins v. Virginia 536 U.S. 304(2002). Stanford and Atkins speak to both issues of capital punishment for juvenile offenders and the mentally retarded. These two cases decided that it was not inappropriate to utilize the de ath penalty for those younger than age eighteen or mentally retarded, respectively. Typically, judicial restraint would have allowed the Supreme Court to overturn the Missouri Courts ruling based on precedents and existing laws. However, the majority opinion took its review of the existing laws by interpreting the intention of the laws and how they related to the intention of the Constitutional Amendments. The majority opinion stated that although the death penalty for youths and the mentally retarded were not prohibited, they were rarely used as methods of punishment. JIM HENSON Jim Henson was born on September 24, 1936, in Greenville, Mississippi. He moved to Maryland in fifth grade and throughout his childhood had a strong interest in both art and television. His grandmother was very supportive of his interests and constantly encouraged him to use his imagination. In 1954 Jim started in television performing puppets on a local channel’s Saturday morning program. The next year, while studying at the University of Maryland, he was given a five-minute show called Sam and Friends which aired twice a day. This show introduced the first Muppets, marionette puppets. The success of this show led him to many appearances on shows such as The Today Show and The Steve Allen Show. During this time Jim began making many humorous commercials for sponsors. With weekly appearances on these shows, Jim asked for the help of a puppet maker name Don Sahlin and a puppeteer name Frank Oz. "From 1964 to 1969 Henson produced several experimental films." In the mid-60’s Jim was asked to create characters to populate a new children’s show, Sesame Street. It was here where he made some of his most famous characters such as Ernie and Bert, Oscar the Grouch, Cookie Monster, and Big Bird. On this show Jim produced over two dozen shorts to teach counting and other basics. Soon after his fame on Sesame Street Jim, after promoting the idea for The Muppet Show for years, finally received backing to produce. On this show the most famous Muppet of all, Kermit the Frog, was introduced along with Miss Piggy, Rizzo the Rat, Rowlf the Dog, Fozzie Bear, and of course Gonzo the Whatever. The Muppet Show became the most widely viewed television program in the world. From this show many movies and spin-off television shows have been produced. Jim Henson died in 1990 from pneumonia right after his last project for Muppet Vision 3-D, an attraction for Disney World, and right before he was going to sell his company to Disney Studios. These tanks were ordered to invade Kuwait by Saddam Hussein, the ruthless dictator of Iraq. The Iraqi troops looted Kuwaiti businesses and brutalized Kuwaiti civilians. Saudi Arabia began to fear that they may be invaded as well, and on August 7th they formally asked President Bush for US assistance. The US pledged to defend the Saudis, and to remove the Iraqis from Kuwait. Great masses of troops from many different nations were deployed in the Persian Gulf area. At 4:30 PM EST on January 16, 1991, the first aircraft with orders to attack Iraqi targets were launched from Saudi Arabia, marking the beginning of Operation Desert Storm. Dictators like Mr. Hussein cannot be allowed to take advantage of smaller countries like bullies after lunch money. There has to be someone to stop them, or they will gain more and more power and land, just as Adolf Hitler tried to do in World War II. That someone, in the case of Mr. Hussein, was the United States, along with a multinational coalition. The US had just cause in entering a war against Iraq because of Iraq's invasion of the small and defenseless nation of Kuwait. Actions such as that must be repulsed. Iraq had no just cause in invading Kuwait; their reasons were either obscure or for their benefit. The US had to help Kuwait regain their nation. In protecting the Saudis from invasion and removing the Iraqis from Kuwait the US had the right intention. The real reason the US decided to fight the Iraqis was to restore Kuwait's government and to defend Saudi Arabia. There was no underlying reason, such as to receive better prices on oil or to make the Kuwaitis indebted to the US so as to receive favors. Throughout the war, the US made clear their purpose and intent in fighting the Iraqis, and not once did they stray from it. Legitimate authority was established when the Congress voted to follow United Nations resolution 678, section two of which "Authorizes Member States co-operating with the Government of Kuwait, unless Iraq on or before 15 January 1991 fully implements, as set forth in paragraph 1 above, the foregoing resolutions, to use all necessary means to uphold and implement resolution 660 (1990) and all subsequent relevant resolutions and to restore international peace and security in the area." 1. His Holiness the Dalai Lama has been seen in the media more than any of his predecessors, which is understandable since his period of reign is much more technologically advanced compared to the others. He has been going to places like Australia, United States, and United Kingdom to give teachings and talks to the followers of his religion. His fight for the independence of Tibet from China is notable. He believes in the sacredness of his religion and the rights of the Tibetans to live independently from China's rule. Although he is presently living in exile, he is still trying to instill the Tibetan culture and tradition to his followers by establishing the Tibetan Institute of Performing Arts and the Central Institute of Higher Tibetan Studies. He has become political in a way due to trying to strengthen his ties with different countries. More recently, there were reports that His Holiness â€Å"attempted to incite sabotage of Beijing's Olympic Games in August 2008† (Telegraph. co. uk, 2008). However, this claim was denied by the Dalai Lama when he stated that â€Å"he did not support a boycott of the Beijing Olympic Games† (Thomson Reuters, 2008). While it seems better when His Holiness focuses on his religion and tries to win the independence of his kingdom, this would be impossible because of how the media has improved at this time, which gives him, his religion, and his people more exposure to the world than the previous Dalai Lamas. 2. â€Å"Yin/Yang is a symbolic representation of the universe that embodies the concept of change, relationships, patterns, process, or flow from one concept into the other, at all levels of existence† (Diamond, 2000, p. 51). One of the areas where yin/yang can be applied is in the field of medicine. Balance is important in a person's health. There are those who experience too much pain that they would try other untraditional ways just to relieve themselves of the pain. Sugaring Recipes to Attract Moths Many moths will come to lights at night, but if you really want to sample the species in an area, you should try sugaring for moths. Sugaring or baiting is an effective and fun way to attract moths to an area. The bait is usually a mixture of fermenting fruit, sugar, and alcohol. When sugaring for moths, you apply the bait mixture to tree trunks, fence posts, stumps, or other structures, usually around dusk. After dark, you visit your bait sites at regular intervals of time to collect or photograph any moths. You can try sugaring for moths any time of the year, but youll have the best results if the temperature remains above 50 °F. Warm, muggy nights are ideal for baiting moths. Making a Sugar Bait for Moths Every moth enthusiast or entomologist I know has their own favorite recipe for sugar bait. The key to effective bait is making a concoction with a strong odor to attract the moths, and a sweet taste to keep the moths around. Finding a mixture that yields good results may take a bit of trial and error on your part. Start with this basic recipe, and modify it to your liking. Basic Sugar Bait Recipe to Attract Moths brown sugaroverripe bananasbeer (stale beer is preferable)molasses Were not baking a cake here, so theres no need to measure anything. Making a good bait for sugaring moths is more a matter of consistency than it is of proportion. You should try to achieve a consistency thick enough to keep it from dripping, but thin enough to spread with a paintbrush. Crush up the ripe bananas and mix them in. Use enough beer to dissolve the sugar. Stir it all together until you have a thick but fluid bait mixture. Some people prefer to age their sugaring bait, by letting it sit at room temperature for a few days. This will allow it to ferment, which will make the bait all the more attractive to the moths. If you choose to do this, dont put your mixture in an airtight container. Use a loose-fitting lid, or cover the container with a paper towel held in place with a rubber band. If you have any stale or skunky beer around, heres your chance to put it to good use. Moths dont mind a stale beer. Other Sugar Bait Ingredients Really, the fun part of sugaring for moths is creating your own perfect bait recipe. Try some of these ideas to modify the basic recipe, and see what works best to attract moths. dry yeast - if youre going to let your mixture sit and ferment, this may be a good addition to tryrumsweet liqueurs, like schnappswhite sugar – can be substituted for brown sugarhoneymaple syruprotting watermelon – some moth enthusiasts swear by watermelon, claiming its the best moth attractant you can findfermenting peaches, pears, or applesblack treacle – a sweet syrup produced when sugar is refinedcola – some people like to simmer the cola, stirring in sugar and perhaps some molasses until it dissolvesorange soda – open it and let it sit for a while, so it goes flat Applying the Sugar Bait to Attract Moths Now that youve mixed your sugar bait, its time to do some mothing! Youll need a paintbrush to apply the concoction. A 3-4 width paintbrush is ideal for this purpose. Take your mixture to the area where you hope to collect moths, and choose a few tree trunks or fence posts that are easily accessible. Paint the mixture on these locations, making about a 12-inch square (smaller, obviously, if the tree trunk isnt that wide) at eye level. If youre planning to photograph the moths, keep that in mind when applying the sugar bait. Make sure the ground is clear of debris or undergrowth, so you can collect or photograph any moths easily. I recommend sugaring the trees around dusk, so the scents of a fresh batch of bait are wafting through the air just when the night-flying moths are waking up from their naps. When youre applying the bait, remember that other insects (ants, anyone?) may enjoy a sugary snack, too. If you want to find moths, you need to be careful not to spill the bait solution as you walk around the area. Dont let the bait mixture drip down the tree trunk, either. You need to make a nice, neat square of sugar bait, without creating trails for ants to follow. If it drips, its not thick enough and you should go back to the kitchen. Adding molasses will usually do the trick. Some people recommend using the bait mixture as a barrier, to keep hungry ants from reaching the bait square intended for moths. Try painting a ring of the sugar bait around the tree trunk, several feet below the moth bait, and also several feet above the moth bait. This should effectively intercept any ants, and keep them preoccupied and away from the moths. Checking the Bait for Moths Now its just a matter of sitting and waiting for the moths to find your irresistibly stinky bait. Youll probably notice the most moth action between the hours of 10 pm and 1 am but check your bait sites every half hour or so. Be careful you dont spook the moths! Dont shine your flashlight directly at the moths. Flashlights with a red filter, or with red LED lights, will make it easier to observe the moths without disturbing them. Keep your flashlight pointing down toward the ground as you approach. As moths in the area detect the scent of the bait, they will fly to the site to investigate. How to Study for a Test in 5 Days How do you study for a test if you have five days? Well, thats a great question! Thankfully, you arent asking, How do you study for a test if you only have one, two, three, or four days. You gave yourself plenty of time to prepare fully for your test and didnt even consider cramming. Heres your 5-day schedule. Ask and Read In school, ask your teacher what type of test it will be. Multiple choice? Essay? Thatll make a difference in how you prepare. Ask your teacher for a review sheet if he/she hasnt already given you one. Also, get a study partner set up for the night before the test if possible–even via phone/Facebook/Skype. Dont forget to take home your review sheet and textbook. When you are at home, eat some brain food. Read your review sheet, so you know whats going to be on the test. Re-read the chapters in the textbook that will be on the test. Thats it for day one! Organize and Make Flashcards Pay attention in class–your teacher may be going over things that will be on the test! Take home your handouts, assignments, and former quizzes along with your textbook and review sheet. At home, organize your notes. Rewrite or type them up so they are legible. Organize your handouts according to dates. Make note of anything youre missing. Go through your review sheet, finding the answers for every question on there from your notes, handouts, textbook, etc. Make flashcards with a question/term/vocabulary word on the front of the card, and the answer on the back. When youre finished, put your flashcards in your backpack so you can study throughout the day tomorrow. Dont forget to stay focused! Memorize Throughout the day in school, pull your flashcards out and ask yourself questions (when youre waiting for class to start, at lunch, during study hall, etc.) Clarify anything you didnt totally understand with your teacher. Ask for missing items and ask if there will be a review before the test later on in the week. At home, set a timer for 45 minutes, and memorize everything on the review sheet that you dont already know using  mnemonic devices  like acronyms or singing a song. Stop after 45 minutes and move on to other homework. You have two more days to study for this bad boy! Put your flashcards in your backpack for more review tomorrow. Memorize Some More Again, pull your flashcards out and ask yourself questions throughout the day. Confirm a study date for tomorrow night. Set a timer for 45 minutes again when you are home. Go back through your flashcards and review sheet, memorizing anything you dont have down pat. Take a 5-minute break. If necessary, set a timer for 45 minutes again and continue if youre still unsure of any material! Put your flashcards in your backpack for review again tomorrow. Study and Quiz Throughout the day, pull your flashcards out and ask yourself questions again. If your teacher is having an exam review today, pay close attention and write down anything you havent learned yet. If the teacher mentions it today–its on the test, guaranteed! Confirm the study date with a friend for this evening. Ten-to-twenty minutes before your study partner (or mom) shows up to quiz you for the exam, review your flashcards. Make sure you have everything down pat. When your study partner arrives, take turns asking possible exam questions to each other. Make sure each of you has a turn asking and answering because youll learn the material best doing both. Stop once youve been through the questions a few times and get a good nights sleep.

The company was having the revenue of about US $ 36.339 Billion in the year 2005 and it is currently employing about 77,000 people approximately, the organizational culture that the company is showing is strong enough in terms of services they are providing right now, it was all due to the fierce competition with Komatsu that the company decided to change its culture in 1990s as a result they are having very strong hold in the market, the culture was weak before 1990s as there were so many of the labor strikes and a lot of shutdown processing, but sooner the company identified its weakness and worked on it, one of the biggest reasons of its success is that now the entire union of employees work together and corporate at their level best with the customer as a result the company has achieved excellence, which was otherwise not possible if there wouldn't be any team work or if there was no maximum utilization of the work force they have. Some authors determine supporting, directive, coercive, transformational leadership styles. The most efficient styles in the majority of establishments of higher education are democratic and supportive styles, but for some types of situations autocratic and directive styles might be appropriate. For example, when the faculty leader wants to set direct goals for the staff members and make them increase their performance, it can be appropriate to use directive style. The choice of the style mainly depends on the environment in the organization and the goals which it needs to achieve. Autocratic and directive styles can sometimes represent some danger of faculty leaders becoming power-oriented. When managers care only about their own power, they tend to choose those 2 styles of leadership. It is well-known that leadership styles can be oriented on the performance of the team or on the concern about staff members. The analysis of these theories is particularly important for managing staff members in educational settings. Blake and Mouton (1964) have introduced a grid in which they identified the main styles of leadership according to those 2 characteristics. Orientation on the performance of the team means that the manager is very concerned about the results which they are going to have in the end of the period, the extent to which goals will be met. This type of managers cannot be accepted in education settings because it prevents the faculty staff from making large contributions to the development of the educational establishment. â€Å"Another style is management called country club management, in which managers have little or no concern for results but are concerned only for people. † (Bjerke, 1999, p. 59). Such companies might not have great results because employees will not be working to the fullest. â€Å"Autocratic task managers are concerned only with developing an efficient operation, who have little or no concern for people and who are quite autocratic in their style of leadership. † (Bjerke, 1999, p. 59). This type of manager is more favorable than the previous one, but it is also inefficient in the educational setting. In order to make the staff work efficiently, the faculty leader needs to choose the style combining both concern about staff members and concern about the performance of the team. It is very difficult to make the faculty function effectively, but this task can be achieved through the right choices of staff members’ motivation and leadership style. The field of education requires a leader with good communication skills, able to provide success-oriented policy, capable of solving all the possible problems which may arise in the team. The King And The Clown | Analysis The movie King and the Clown has touched a subject that is considered as a proscribed and outlawed by the Korean society and yet it has struck a chord with the Korean people.The movieKing and the Clown, has some the most marvelous and enthralling performances by the actors. The movie has a controversial theme of homosexuality which has the potential to upset the emotions and mindsets of many of the conservative Koreans, but each element of the movie is so convincing and perfectly played that the causal idea never seems to look vulgar. It has managed to keep the balance in between too shocking or being overly-exaggerated. There are a lot of mixed emotions in the movie which are tied to the characters itself. There is love, hatred, jealousy, trust, anger, surprise remorse, aggressiveness. As the movie goes on, the viewer tends to experience all these feelings, and sometimes even imagine himself in the place of the characters. The ability to connect with the audiences despite being set up on such a controversial topic is what sets the movie apart. Background The movie The King and the Clown has its background set in the Joseon Dynasty. This resembles many of the generic Korean dramas we haves seen in many movies, but the plot here is quite original and well scripted. The story of the movie takes in its center, a band of impecunious and hard-up traveling entertainers. Movies two main characters are Jang-Saeng and Gong-il. They are both lovers. Both of them being of the same sex is quite shocking to many Koreans and also is quite new to be seen in the Korean movies. But the catch here is that Gong-il whose role is being played by actor Lee Jun-ki, has very feminine feature and one could at a thought think of him as a girl; and at some moment one almost want to believe that the actor is a girl. Both of the actors have shared a very strong bond throughout the movie. Some of the scenes of the movie has clearly shown the great chemistry shared by both. It seems that they really look out for one another. In the starting, both of them decide to go to Hanyang (now Seoul), in order to expand their talents and present themselves to a lot more people and make their show bigger and better. It is there that they find many other similarly and hugely talented minstrels and then join their act. Now to do something new and to gain fame and money, ang-Seang, who is the chief of the troupe, they decide to mock the king and his favorite Nok-Su as this would attract a lot of people to their act. Now as their fame spread, one of the kings official get winds of their act and get them arrested for treason against the state. The official then puts a condition in front of them that they have to perform in front of the king and if he likes their show, their life would be spared. This was in fact a plan of the official to let the king know about the injustice and corruption spread in his territory through the mocking. The Kings court Now the role of the King is played by actor Jung Jin-Young who portrays the tyrannical king brilliantly. It is said that the kings character in the movie is based on a real-life king. The king has also got problems of his own and was psychologically disfigured because his mother was forced to commit suicide by the kings of that time and this made him repulsive towards the people and the society. As he grew up, he started showing the signs of unstable caprices of a child who was hurt, wounded and spoiled by that incident. But as the clowns performed, instead of feeling insulted and shameful, the King became very amused with the acts and decided to keep the troupe as court jesters in the kings grand palace. This is truly magnificent as it shows sides of the king which make us believe as the king was a born actor as by chance got his royal bloodline. This could also be interpreted as the kings real or hidden dream. As time passed on the King becomes more and more captivated with Gong-il s bent and sexless beauty. This on the other hand made Jang-Saeng, Nok-su and the ministers feel jealous of Gong-il. The relationship between the two clown Kam Woo-Seong has portrayed the role of the unconditional hero as the masculine clown, Jang-Saeng. Lee Jun-ki has totally and justly become a superstar due to his portrayal of Gong-il who is sensitive and loving, the feminine clown. This has really made us to think that is Lee, Jun-ki gay in real life? This is because of his marvelous performance in the movie. There is so much boldness required to play a character like the one our hero has played. The relationship between the clowns is quite extraordinary. There is a rebellious nature to this dynamics. There is an emotional conflict and a mixture of feelings between the two clowns in the movie Jang-sang and Gong-gil. But this conflict is implied rather than made explicit. This forms an intrinsic element of the movie and has a lot of emotional charge within it. The friendship of Jang-sang and Gong-gil sometimes appear to be platonic; Both of them understand and care about one other and the affinity and the connection between them defines and to an extent, affet their actions and decisions later. But that same affinity also has its down-side. There is frustration, fixation and passion; Jang-sang sulks and hates it when Gong-gil is in the Kings company and prefer it rather than his, and Gong-gil is gloomy and downhearted when Jang-sang isnt around. Their emotional connection is intensified by the script itself and also the viewers interest in their friendship with a lot of intensity attached. Directors views The director Lee Jun Ik has already said that the main point of the story was not to raise the issue of homosexuality but the focus was mainly on the life and the worlds of the travelling clowns. It wanted to show and also facts say that it was very common for the traveling clowns to engage in same-sex relationships in those days. The people were quite poor and it was impossible for them to get a wife in this financial situation. Secondly, there were only men who were traveling in groups together and it was very possible for them to make a bond that was very tight and intimate Conclusion The movie King and the Clown is likely to be said a chronological drama wherein there was lot of emotions attached to it. Also it touched on an issue that is controversial yet is seen vary widely in todays society. Also to say that it had a original plot and highly brilliant actors. The movie very gracefully and tactfully breached one of the subjects that is always been considered taboo. Also the movie has demonstrated how art imitates life. The clown sexuality is completely and willingly accepted in the movie. So one can say that this movie may prove to be a milestone for gay rights and teaches about arts association with life.

Dreams in Song of Solomon, Narrative of Frederick Douglass, Incidents in the Life of a Slave Girl, and Push    In 1776 it was stated that our country was based upon one simple truth, "That all men are created equal; that they are endowed by their creator with certain inalienable rights; that among these are life, liberty, and the pursuit of happiness." Though stated with a poetic justice, this statement did not hold true for all U.S. citizens. Many citizens were held in captivity, versus freedom, unable to pursue those "inalienable rights." After two hundred years of inequality, Martin Luther King, Jr., would provide one of the most vocal positions regarding the lack of equal rights owed to African Americans. In his 1969 Lincoln Memorial speech, King would historically state, "I still have a dream. It is a dream deeply rooted in the American dream, that one day this nation will rise up and live out the true meaning of its creed - we hold these truths to be self-evident, that all men are created equal."    Like most Americans, African Americans have developed several variations of the American Dream. Many African Americans find that their dream differs from the traditional American dream in that there is no immediate success. Sometimes it consists of equality via liberty and/or literacy, while at other a simple desire to know self through historical connection. Dreams of this nature have been a major underlying theme of African-American literature since the 1800's.    In the mid-1800's Frederick Douglass began sharing his story of slavery with what was then considered the "North." Douglass realized his dream early in life and worked to achieve as much of the dream as possible. RECENT HISTORY OF PRIVACY PROTECTION Communication Act of 1934 -it restricted the government’s ability to secretly intercept communications. However, under a 1968 federal statute, law enforcement officers can use wiretapping if they first obtain a court order. Wiretapping – the interception of telephone or telegraph communications for purpose of espionage or surveillance. Freedom of Information Act (FOIA) – (passed -1966, amended-1974) provides the public with the means to gain access to certain government records such as the spending patterns of an agency, the agency’s policies and the reasoning behind them, and the agency’s mission and goals. Fair Credit Reporting Act (1970) – this act regulates the operations of credit-reporting bureaus, including how they collect, store, and use credit information. – it is designed to promote accuracy, fairness, and privacy of information in the files of credit reporting companies and to check verification systems that gather and sell information about people. Privacy Act (1974) – declares that no agency of the U.S. government can conceal the existence of any personal data record-keeping system, and that any agency that maintains such a system, must publicly describe both the kind of information in it and the manner in which the information will be used. – the Central Intelligence Agency (CIA) and the law enforcement agencies are excluded from this act. – the Organization for Economic Cooperation and Development (OECD) â€Å"Fair Information Practices† are often held up as a model of ethical treatment of consumer data for organization to adopt. KEY PRIVACY AND ANONYMITY ISSUES GOVERNMENTAL ELECTRONIC SURVEILLANCE Federal Wiretap Act (U.S. Code Title 18 Part 1, Chapter 119, Wire and Electronic Communications Interception and Interception of Oral Communications) – it requires processes to obtain court authorization for surveillance of all kinds of electronic communications, including e-mail, fax, internet, and voice, in criminal investigation. Executive Order 123333 (U.S. Pres. Reagan, 1982) – legal authority for electronic surveillance outside the U.S. It permits intelligence agencies to intercept communications outside the U.S. without a court order. Communication Assistance for Law Enforcement Act (CALEA, 1994) – it covers radio-based data communication. The Federal Communications Commission (FCC) required providers of Internet phone and broadband services to ensure that their equipment can allow police wiretaps. USA Patriot Act of 2001 – Gives sweeping new powers to Domestic law enforcement and International intelligence agencies. It contains several sunsets that gives the government much more surveillance capability. Sunset provisions – can terminates itself or portions after a specific date unless further actions is taken to extend the law DATA ENCRYPTION Cryptography – the science of encoding messages so that only the sender and the intended receiver can understand them. Encryption – the process of converting an electronic message into a form that can be understood only by the intended recipients. Spyware – is a term for keystroke-logging software that is downloaded to users computer without adequate notice, consent, or control for the user. It creates a record of keystrokes entered into the computer with or without internet and will send to the email of the spy when internet connections are available. The act failed to slow the flow of spam but instead, it actually increased the flow of spam by legalizing it. ADVANCED SURVEILLANCE TECHNOLOGY Advanced surveillance technology provide a new data gathering capabilities, however, these advance can also diminish individuals privacy. Advocates of the technology argue that people have no legitimate expectations of privacy in a public place. Camera Surveillance – is one of the most common advanced system used in surveillance nowadays. Businesses can come across many conflicts between stakeholders, which are the people that are impacted by the business. Cadbury, the chocolate producer, has started an organization, worth  £9 million pounds, to put sports equipment in school across the UK. Customers would need to save tokens from chocolate bars and give them to the schools. To get the first equipment, 750 tokens are needed. While to allow the school to obtain a variety of different equipment, it needed 2000 tokens. For schools who can’t afford these new equipment, this idea was very appealing. Cadbury’s ‘Get Active Campaign’ was sponsored with deals from Cadbury and the government by top sports stars such as boxer Audley Harrison and runner Paula Radcliffe. However the company and the government were blamed for increasing the rate and the chances of obesity in young people, because they would eat more chocolate through this scheme. Some stakeholders that are affected by this scheme would be the customers, the competition, the workers, the government, and the shareholders. The customers would be affected by this scheme because they increase the problems of obesity in young people, by eating the Cadburys chocolate in order to receive sports equipment. Cadbury would become more popular and common and after people have tried their chocolate through this scheme, it would encourage them to go buy more, which increases the profit for Cadbury. This would also lead to a stiffer competition between other chocolate and food producing companies. This scheme would be known as a fast effective way of advertising Cadburys chocolate. The workers would also be affected because they would be demotivated and therefore are unlikely to produce good quality products or deliver good customers services. Also, through the scheme, Cadbury would spend  £9 million, and therefore, during the process of trying to sell more chocolate and earn more money, their workers would earn a lower salary. The government would be affected because they would be criticized for encouraging children to eat more chocolate. The shareholders are affected because they would receive a lower profit if the profit margin is dropping. The businesses responsibility would be to provide for the population and to fulfil their wants and needs. In this case, Cadbury is providing for both its customers, and the school. It’s responsibility is to also provide jobs for the society. These people make money to support themselves and their families, pay taxes and use their wages to buy goods and services. The businesses responsibility towards competitors would be to be honest in their business practice. The businesses duty towards its workers would be creating a safe work environment, to pay workers of a business a minimum hourly wage, and to pay each worker money owed from working per paid period, including overtime, sick leave, and vacation wages. It is also the responsibility of the business to train workers in safe procedures to minimize the risk of injury. Also it is a business duty to create a working climate that fosters respect and fair treatment of every worker regardless of age, gender, race etc. The businesses responsibility towards the government is to pay taxes, follow environmental regulations (they need to limit the number of pollutants they expel), to maintain law and order etc. Finally, the businesses responsibility towards the shareholders is to build and maintain generosity in the eye of society, to provide goods and services, and to earn a profit and bring money to the company and the investors. Conflicts that might exist between stakeholders would be between society and the company and government. Even though the government supports Cadbury’s ‘’Get Active Campaign†, the general public is speaking that the only candy company is using the concept of being active to lure children to purchase more chocolates. It would also increase the number of calories the children take in (1.2 million) since to receive only one piece of sports equipment (e.g a volleyball set), children must collect $2000. Thus, leading to obesity at a young age. Another conflict that might result is between customers and the company. The customers buying the chocolate might realize that the campaign is just a scheme created to sell more chocolate, yet neglects the importance of healthy exercise. Some solutions to the conflicts that the businesses faces would be that Cadbury should cancel the concept of accumulating chocolate tokens. It is the responsibility of companies to encourage customers to live a fit  lifestyle, not a plan to sell more chocolate. In order to solve the conflict, Cadbury should cancel and donate the sports equipment to financially struggling schools as an act of charity. Public relations firms specialize in dealing with negative publicity. There are many ways to solve problems between different stakeholders. Each business stakeholders have their own business objective. They usually have different opinions and have to disagree about some decisions. Finding a solution can satisfy both the conflicting stakeholders.

These all ten organizational relationships are exceedingly complementally; however they only generate benefits when they are all utilized and implemented. Southwest makes profit on average if only the last five seats on a plane are filled. This Airline as a regional carrier is unique. Southwest is popular among the passengers since they carry their customers’ non-stop from point A to point B. southwest provides no interline connections with the other airlines, except for Icelandic Air connections. This helps in wise use of time since airplanes are not delayed by ticket counter lines or connecting travelers. Their strategies have also helped in reducing the unemployment rates in United States.
